When a written view is useful
A written opinion may help when a board or investor needs a reasoned assessment, a contract creates a material uncertainty, parties are considering a dispute, or a private client needs to compare options involving property or family assets. Define the question first
A useful opinion answers agreed questions. A broad request to “review everything” can produce an unfocused and expensive exercise. Specify the decision to be made, the relevant time frame, the jurisdictions involved and whether the work is a preliminary assessment or a deeper document review.
Prepare a reliable document set
Provide the signed agreements, amendments, correspondence, key dates and a short chronology. Point out facts that are disputed or unknown. The analysis can only be as reliable as the material supplied. If assumptions must be made, they should be identified in the opinion rather than presented as established facts.
Understand the deliverable
A written opinion usually sets out the questions, facts and documents reviewed, assumptions, analysis, qualifications and practical conclusions. It is not a guarantee of a court result or a substitute for instructions to take action. Scope, fee and delivery timeline should be agreed before work starts.
